These Text Message Terms & Conditions apply to individuals who consent to receive SMS messages from Syneos Health, Inc. (“Syneos Health”), its affiliates, subsidiaries, or service providers in connection with patient support services and programs administered by Syneos Health, including Risk Evaluation and Mitigation Strategy (REMS) programs.

Program Description

Syneos Health may send SMS messages to individuals who have enrolled in a program and provided consent to receive text messages. These messages are intended to support participation in program-related services and may include:

  • Program notifications
  • Enrollment confirmations
  • Appointment or activity reminders
  • Program status updates
  • Contact information for assistance

Messages sent through these programs are operational and informational in nature and are not promotional unless expressly stated otherwise at the time of consent.

Consent to Receive Messages

Individuals may opt in to receive SMS messages by providing their mobile phone number and consent through a Syneos Health enrollment, registration, or program participation process. In some programs, consent may be provided through a written enrollment form completed with a healthcare provider, pharmacy, care team member, or program representative.

Consent to receive text messages is optional and is not a condition of purchasing any goods or services or participating in a program unless SMS is specifically required for that program workflow and clearly disclosed.

By opting in, you agree that Syneos Health may send SMS messages to the mobile phone number you provided using automated or manual means, as permitted by applicable law.

Message Frequency

Message frequency varies depending on the program and your communication needs. You may receive recurring messages based on your enrollment, status, and interactions with Syneos Health.

Message and Data Rates

Message and data rates may apply depending on your wireless carrier and service plan. Syneos Health does not charge a separate fee for SMS messages.

Opting Out

You may opt out of receiving text messages at any time by replying STOP to any message you receive from Syneos Health.

You may also contact Syneos Health at +1 866 875 1569 to request that text messaging be discontinued.

After you opt out, you may receive one final confirmation message confirming that your request has been processed.

Your Responsibilities

By participating in a Syneos Health SMS program, you represent that:

  • You are the account holder for the mobile phone number you provide or have authority from the account holder to provide that number
  • You are authorized to incur any mobile message or data charges related to SMS communications
  • You will provide accurate and current contact information
  • You will notify Syneos Health if your mobile number changes or if you are no longer the regular user of the number provided
  • You will not use the SMS service for any unlawful purpose

Availability and Delivery

SMS services may not be available on all mobile devices or through all wireless carriers at all times. Message delivery depends on effective transmission by your carrier and is subject to factors outside of Syneos Health’s control. Syneos Health does not guarantee successful or timely delivery of SMS messages.

Privacy

Your information will be handled in accordance with the Syneos Health Privacy Notice.

Syneos Health does not sell, rent, or share SMS consent or mobile phone numbers with third parties for their own marketing purposes.

Changes to These Terms

Syneos Health may revise or update these Text Message Terms & Conditions from time to time. Any updates will become effective when posted to this page. Your continued participation in SMS communications after updates are posted constitutes acceptance of the revised terms.

Termination

Syneos Health may suspend or terminate SMS communications at any time, including if it reasonably believes misuse, legal risk, or operational need requires such action.

Dispute Resolution and Arbitration; Class Action Waiver

To the extent permitted by applicable law, disputes arising from these Text Message Terms & Conditions or your use of SMS services may be resolved through binding arbitration on an individual basis rather than in court, except where prohibited by law or where a dispute qualifies for small claims court.

By participating in SMS communications, you agree that any dispute will be brought only in your individual capacity and not as part of any class, consolidated, or representative proceeding.

If applicable law does not permit arbitration or class action waiver for a particular claim, that portion will not apply, but all remaining provisions will remain in effect to the fullest extent permitted by law.

Applicable Law

These Terms are governed by applicable U.S. federal law and, where not preempted, the laws of the State of North Carolina, without regard to conflict of law principles.

Disclaimer of Warranties and Limitation of Liability

Syneos Health provides SMS services on an “as is” and “as available” basis and disclaims all warranties, express or implied, to the fullest extent permitted by law.

To the maximum extent permitted by law, Syneos Health will not be liable for indirect, incidental, special, consequential, or exemplary damages arising out of or relating to SMS communications, including delayed, failed, or misdirected messages.
